2. About Bayan Kadiwa
Bayan Kadiwa Parcel Delivery is operated by Freshpost Delivery Inc., a company registered with the Securities and Exchange Commission in the Philippines. We provide local parcel pickup, dispatch coordination, delivery updates, and proof-of-delivery support.
3. Service Availability
Services may be available only in selected cities, barangays, routes, operating hours, or coverage zones. We may accept, reject, reschedule, or cancel a booking due to capacity, rider availability, weather, road conditions, safety, incorrect details, or legal restrictions.
4. User Responsibilities
You are responsible for complete and accurate sender, receiver, pickup, drop-off, contact, parcel, and handling information. You must properly pack items and ensure the parcel is lawful, safe, and acceptable for delivery.
5. Parcel Acceptance
We may accept ordinary documents, sealed envelopes, small packages, seller orders, packed personal items, and other parcels that meet our size, weight, safety, and service limitations.
6. Restricted and Prohibited Items
Unless approved in writing, you must not send cash, negotiable instruments, passports, government IDs, illegal substances, weapons, hazardous materials, live animals, counterfeit goods, stolen items, or items prohibited by Philippine law.
7. Pricing, Fees, and Payments
Delivery prices may depend on route, distance, parcel size, vehicle or rider type, urgency, waiting time, add-on services, tolls, parking fees, surcharges, and operating conditions.
8. Pickup, Delivery, and Proof
Pickup and delivery times are estimates unless we expressly confirm a guaranteed service. Proof of delivery may include receiver name, signature, photo, timestamp, location reference, rider note, or other reasonable evidence.
9. Failed Deliveries and Returns
A delivery may fail if the receiver is unavailable, the address is incorrect, access is restricted, contact details are wrong, the parcel is refused, or the area is unsafe. Cancellation, waiting, redelivery, or return fees may apply.
10. Loss, Damage, and Claims
Bayan Kadiwa will take reasonable care in coordinating delivery, but we are not responsible for loss or damage caused by improper packing, incorrect information, prohibited items, force majeure, or circumstances beyond reasonable control.
11. Merchant and Business Users
Merchants and business users are responsible for customer communication, product quality, lawful sale of goods, correct order preparation, packaging, labels, and promises made to their customers.
12. Rider and Partner Conduct
Riders and partners are expected to follow service standards, safety rules, parcel handling procedures, and lawful conduct requirements.
13. Intellectual Property
The Bayan Kadiwa name, logos, graphics, website content, service marks, visual identity, and related materials are owned by or licensed to Freshpost Delivery Inc.
14. Privacy
Personal data is handled according to our Privacy Policy and applicable Philippine data protection laws.
15. Limitation of Liability
To the maximum extent allowed by law, Bayan Kadiwa and Freshpost Delivery Inc. will not be liable for indirect, incidental, special, punitive, or consequential damages.
16. Changes to These Terms
We may update these Terms from time to time. Continued use of Bayan Kadiwa services after changes means you accept the updated Terms.
17. Governing Law
These Terms are governed by the laws of the Republic of the Philippines.
